Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Ultimate Tier List (“we,” “us,” “our,” or “the Service”) that governs your access to and use of ultimatetierlist.com. Please read them together with our Privacy Policy.

Preamble: Fair Use & Transformative Use

Ultimate Tier List is a platform for commentary, criticism, ranking, and personal expression. The tier lists, templates, and images that appear on the Service are created and uploaded by users to compare, rank, and comment on existing works. This content is intended to be transformative and to qualify as permitted use under applicable law — including the fair-use doctrine recognized in the United States (17 U.S. Code § 107) and the exceptions for quotation, criticism, review, and illustration recognized under Ukrainian copyright law and international treaties such as the Berne Convention.

Cover images, posters, logos, and artwork remain the property of their respective owners. They appear on the Service for identification, reference, and commentary only, and their inclusion is not a claim of ownership or an assertion of any affiliation with their owners.

1. Acceptance of Terms & Age Restriction

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

You must be at least 18 years of age to use this Service. By creating an account or using the site, you represent and warrant that you are 18 or older. If you do not meet this requirement, you must not access or use the Service. See also our commitment to children’s privacy in the Privacy Policy.

2. Accounts & Security

To use certain features, you must register for an account. You may register with an email address and password, or by signing in through a third-party provider such as Google. You agree to provide accurate information and to keep it current.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at myultimatetierlist@gmail.com if you suspect unauthorized use. We may reclaim or change usernames that are inactive, infringing, impersonating, or otherwise inappropriate.

3. Your Content, License & Code of Conduct

The Service allows you to upload images and create tier lists and custom ranking templates (“User Content”). You retain all ownership rights to your User Content. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for example, to resize and crop images or to generate thumbnails, covers, and downloadable images), publish, publicly display, and distribute your User Content in connection with operating, improving, and promoting the Service. This license ends when you delete your User Content or your account, except for content that has already been shared with others or that we must retain as described in Section 5.

You represent and warrant that you have the rights necessary to upload your User Content and to grant the license above, and that your User Content does not violate these Terms or any law.

As a user of the Service, you strictly agree NOT to upload content or engage in activity that:

• Infringes the intellectual property, patent, or trademark of any third party.
• Sexualizes minors in any way or depicts child sexual abuse material — we report such content to the relevant authorities.
• Contains pornography, sexually explicit material, or exploits anyone in a sexual manner.
• Contains graphic violence or gore, or promotes physical harm or self-harm.
• Promotes hate speech, harassment, bullying, or discrimination based on race, ethnicity, gender, religion, disability, or sexual orientation.
• Impersonates any person or entity, or discloses another person’s private information without their consent.
• Distributes spam, unauthorized advertising, deceptive links, or malware.
• Uploads viruses, trojans, or malicious code designed to disrupt or damage the Service.
• Uses automated scripts, bots, scrapers, or data-mining tools to extract data from the Service or to place an unreasonable burden on our infrastructure.

4. Creator Submissions

The Service lets users submit rankings attributed to public figures or content creators (“Creator Runs”), supported by a link to a source video or other proof. When you submit a Creator Run, you represent that: (a) the ranking accurately reflects what the named creator actually published; (b) the proof link genuinely supports the submission and you are entitled to share it; and (c) you are not impersonating the creator or implying their endorsement.

You may also add a new creator profile to the Service, including the creator’s name and image. When you do, you represent that the information is accurate, that you have the right to upload any image you provide, and that you are not impersonating the creator. Creator profiles are provided for reference and commentary only and do not imply the creator’s involvement with, or endorsement of, the Service.

We review Creator Runs before they appear publicly, but we do not guarantee their accuracy. Listing a creator on the Service does not imply any affiliation with, sponsorship by, or endorsement from that creator. Creators, or their authorized representatives, may contact us at myultimatetierlist@gmail.com to correct or remove content that concerns them.

5. Moderation, Reporting & Enforcement

We provide tools that let you report content or accounts you believe violate these Terms. We review reports but have no obligation to monitor all User Content. We reserve the right, in our sole and absolute discretion and without notice, to pre-screen, refuse, reject, label, remove, restrict, or disable access to any content, and to warn, suspend, or terminate any account, for any reason — including content we consider unlawful, harmful, or otherwise objectionable.

Some content may be retained after it is removed where we reasonably need it for safety, legal, or moderation purposes. See our Privacy Policy for details on retention.

6. Intellectual Property & Copyright

The Service itself — including its design, code, logos, and branding — is owned by Ultimate Tier List and protected by intellectual property laws. You may not copy, modify, or create derivative works of the platform itself without our written permission.

We respect the intellectual property of others and respond to valid copyright complaints. If you believe content on the Service infringes your copyright, send a notice to our copyright contact at myultimatetierlist@gmail.com that includes:

• Identification of the copyrighted work you claim has been infringed.
• The location (URL) of the material on the Service you claim is infringing.
• Your name, address, and contact information.
• A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
• Your physical or electronic signature.

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice with equivalent information to the same address. In appropriate circumstances we will disable or terminate the accounts of repeat infringers. We honor takedown requests in accordance with the U.S. DMCA and applicable Ukrainian and international copyright law.

7. Third-Party Content & Attributions

Some item information and images — for movies, TV shows, games, anime, and books — are retrieved from third-party services, including The Movie Database (TMDB), IGDB, Tenrai/MyAnimeList, and Google Books. Those names, logos, and works are the property of their respective owners and are used for identification and reference only. The Service is not endorsed or certified by any of these providers. Required attributions are listed in the About section of the Service, and your use of such content may also be subject to those providers’ own terms.

You may not scrape, bulk-download, copy, harvest, or redistribute the catalog data or images obtained from these third-party providers through the Service, and you must comply with each provider’s own terms when interacting with their content.

8. Feedback & Submissions

Any questions, comments, feature suggestions, or ideas (“Submissions”) you provide to us are non-confidential and become our property. We may use and share these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content shared by users is accurate or reliable. Your use of the Service is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Ultimate Tier List and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising from or related to your use of or inability to use the Service. To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us, if any, in the twelve months before the claim arose, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ultimate Tier List and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service at any time, and you may delete your account whenever you like from your profile’s Account Settings (Edit Profile → Delete account), or by contacting us at myultimatetierlist@gmail.com. We may suspend or terminate your access immediately, without notice, if you breach these Terms or engage in conduct we deem harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive — including those on intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

When your account is deleted, we remove your account data and the tier lists you own. Content that is not your personal property — such as creator rankings and any creator profiles you added — is retained but disassociated from your account, and templates you published may be hidden while preserved so that other users’ rankings built on them keep working. 13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to its conflict-of-law rules. You agree that the courts located in Ukraine will have jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your country of residence, including any right to bring proceedings in your local courts.

14. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.

15. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the “Last Updated” date above and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
