Terms of Service - Ultimate Tier List

Preamble: Fair Use Statement

Ultimate Tier List is a platform designed for commentary, criticism, and personal expression. The images and user-generated content uploaded to this site are intended to be used under the principles of fair use (17 U.S. Code § 107) for transformative purposes.

1. Acceptance of Terms & Age Restriction

By accessing or using Ultimate Tier List ("the Service"), you agree to be bound by these Terms. You must be at least 18 years of age to use this Service. By creating an account or using the site, you represent and warrant that you are 18 or older. If you do not meet this requirement, you must not access or use the Service.

2. Accounts and Security

To use certain features, you must register for an account by providing a username, email address, and password. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User-Generated Content & Code of Conduct

The Service allows you to upload images and create custom ranking templates ("User Content"). You retain all ownership rights to your User Content, but grant us a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute it on the Service.

As a user of the Service, you strictly agree NOT to upload content or engage in activity that:

Infringes on the intellectual property, patent, or trademark of any third party.
Contains pornography, sexually explicit material, or exploits anyone in a sexual manner.
Contains graphic violence, gore, or promotes physical harm/self-harm.
Promotes hate speech, harassment, bullying, or discrimination based on race, gender, religion, or orientation.
Is used to distribute spam, unauthorized advertising, or deceptive links.
Attempts to upload viruses, trojans, or malicious code designed to disrupt the Service.
Utilizes automated scripts, bots, scrapers, or data-mining tools to extract data from the Service or burden our servers.

We have no obligation to monitor all User Content, but we reserve the right, in our sole and absolute discretion, to pre-screen, reject, or delete any User Content at any time and for any reason.

4. Copyright & DMCA Policy

We respect the intellectual property rights of others. If you believe your copyrighted work has been uploaded to our Service without authorization, please contact us at myultimatetierlist@gmail.com with a description of the work, a link to the infringing material, and a statement of your good faith belief that the use is unauthorized. We reserve the right to remove infringing content and terminate the accounts of repeat infringers.

5. Site Management & Termination

We reserve the right, but not the obligation, to monitor the Service for violations of these Terms. We reserve the right to refuse service, remove or edit content, or terminate accounts at our sole discretion, at any time, without notice or liability.

6. Feedback and Submissions

Any questions, comments, feature suggestions, or ideas ("Submissions") you provide to us are non-confidential and shall become our sole property. We own exclusive rights to use and disseminate these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ULTIMATE TIER LIST OR ITS CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Ultimate Tier List and its creators from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles.
